Senior Executives and Directors

Things can become a lot more complicated when you are a Senior Executive or Director in an organisation. Areas of dispute can be intense and the issues wide ranging. Often large sums of money are involved,  sometimes bringing about claims that fall outside the Employment Tribunal’s jurisdiction. Contracts & directors’ service agreements

The more senior your role in an organisation, the more likely you will be issued with a Contract or Service Agreement that reads more like a book than a statement of your Terms and conditions. Some of the small print in your Agreement could have significant impact on you in employment and completely tie your hands when your employment comes to an end. This is  particularly true  where commission arrangements, bonuses and post termination restraints come into play. Rather than leave anything to chance, it is far better to have the Contract or Service Agreement professionally checked before you sign on the dotted line and while there is still time to negotiate over terms which could later become the source of litigation.

Exit strategy and severance

The reality in disputes between Executives and their employer often is that severance on agreed terms is the only option. In these circumstances your priority is to get the best possible deal that both recognises your legal rights and enables you to move forward. As a senior executive your concerns will go beyond the severance payment and a reference. You may, for example, need to resign from directorships or other offices, take action to protect your shares and stock options or negotiate your release from post termination restraints. That is where our experience in handling Settlement (Compromise) Agreements comes in.
